Toulouse Appeals Court Holds Final Hearings On Legality Of Planned A69 Highway

Juli Rover, one of the main lawyers for the A69 opponents, speaks to them after the hearings. A final hearing on the legality of the environmental authorizations for the planned highway A69 between Toulouse and Castres takes place in the Administrative Court of Appeal of Toulouse. Plaintiffs against the A69 ask the court to nullify all environmental authorizations given for the A69 project. Opponents gather in front of the Administrative Court of Appeal during the hearings. They argue that this highway is not legally sound, that NGE/Atosca (the builders) do not respect even their own documents regarding ecological compensations, and that there are violations against opponents and non-compliance with regulations. NGE/Atosca and the Minister of Ecology plead that this highway is 'necessary by nature' and that the first decision of the Administrative Court to scrap the authorizations is an 'anomaly'. The verdict will be given on December 30, 2025. The main association, 'La Voie est Libre' (meaning 'The Way is Free'), wants the construction of the highway to be stopped until all judicial decisions on the matter are given. Opponents of this project say that the reprofiling of the N126 will be sufficient for the 6,000 vehicles planned per day and would cost far less money. An opponent of the planned A69 highway holds a placard reading 'to fight is good for health' in front of the Administrative Court of Appeal of Toulouse after the hearings. A rare hearing takes place in the Administrative Court of Appeal of Toulouse, where plaintiffs against the A69 are joined by the SAF (Union of French Lawyers) to request the recusal of two judges who participated in a ruling that reauthorized the continuation of work on the planned A69 highway. Plaintiffs have already asked these judges to recuse themselves, but they refused. Plaintiffs go to the Administrative Court of Appeal, stating that these judges must be recused to protect the confidence of French citizens in the administrative courts and the entire judicial system. Lawyers also argue for the impartiality of the justice system. More than a dozen lawyers are present, as this is a very rare case in the French justice system. According to custom, if a judge has already judged a case, he recuses himself if the same case goes to court again. The main association, 'La Voie est Libre' (i.e., 'The Way is Free'), wants the construction of the highway to be stopped until all judicial decisions on the matter are made. Protesters and members of the Confederation Paysanne are gathering in a field that will be destroyed by the construction of the A69. Nearly 5,000 people are participating in a weekend of action called 'Roue Libre' in the Tarn department against the controversial A69 highway between Toulouse and Castres. The farmers' union, Confederation Paysanne, is planting trees and seeds on a portion of the field that will be destroyed by the A69 highway. Several political parties, unions, and NGOs (Attac, LVEL, Confederation Paysanne, GNSA, XR, etc.) are calling for this weekend of protest. Police are trying to block the exit from the camp to protesters. Several processions are taking place and are going to different locations. Protesters are trying to reach several objectives and are being blocked by 1,200 riot police, two helicopters, two armored vehicles, and a deluge of tear gas canisters and explosive grenades. More than 20 protesters are being injured by riot police, and two are being driven to the hospital due to their injuries. The main association 'La Voie est Libre' (i.e., 'The Way is Free') wants the construction of the highway to be stopped until all judicial decisions on the matter are given. All expropriations for farmers are not cleared. Opponents of this project say that the reprofiling of the N126 will be sufficient for the 6,000 vehicles planned per day and would cost far less money. The A69 highway is costing EUR512 million (in 2018 euros without inflation) for 54 kilometers. More than 100 protected species and 400 hectares of agricultural fields are being destroyed. Michel Forst, the United Nations Special Rapporteur on the situation of human rights defenders, is visiting the 'Crem'Arbre' ZAD (Zone To Defend) to see for himself if there are allegations of excessive police violence, deprivation of food and water, etc. During his visit, the riot police are not allowing any media to follow him into the ZAD. Even the two MPs, Karen Erodi and Anne Stambach-Terrenoir, are not allowed. In Saix, France, on February 22, 2024, opponents have set up a ZAD called 'Crem'Arbre' on the planned A69 highway between Toulouse and Castres, and 'Ecureuils' (squirrels) are living in the trees to prevent them from being cut down. The Gendarmes Mobiles (riot police) are intervening to clear the ZAD of all opponents and are now standing guard near the trees occupied by 'Ecureuils' to block the supply of food and water by sympathizers. The Gendarmes Mobiles have cleared the nearby area of all opponents, and a special unit of policemen, CNAMO, is intervening to dislodge the 'Ecureuils' from their trees. After two days of police efforts, they have only dislodged one 'Ecureuil'. However, new trees are being occupied by 'Ecureuils' in a new place called 'Cal'Arbre'. The main collective 'La Voie est Libre' (The Way is Free) wants the highway project to be stopped until all judicial decisions on the matter are made. All expropriations for farmers have not been settled. Opponents of the project argue that reprofiling the N126 would be sufficient for the 6,000 vehicles planned per day and would cost far less money. The A69 highway is projected to cost EUR512 million (in 2018 euros without inflation) for 54 kilometers, and its construction would destroy more than 100 protected species and 400 hectares of agricultural fields.
